Sources of Fatwa and Its Guidelines

The issuance of a fatwa relies on several primary sources:

  1. The Hanafi school, in addition to the other three schools of the Salaf (early scholars): It is considered a great juristic wealth, from which the most preponderant (strong) opinions are chosen, based on the soundness of their evidence and the appearance of their benefit.
  2. Agreed-upon Sources of Islamic Legislation: These include the Quran, the Sunnah, consensus (ijma), and analogy (qiyas), which are considered the fundamental foundations of legislation.
  3. Disputed Sources of Islamic Legislation: Such as juristic preference (istihsan), public interest (maslahah mursalah), blocking the means (sadd al-dhara’i), presumption of continuity (istishab), custom (‘urf), the opinions of companions (madhhab al-sahabi), and laws from previous nations (shar’ man qablana). These are utilized under specific conditions and guidelines recognized by scholars, particularly when their application serves the interests of the community.

In issuing a fatwa, the following is observed:

Correct Reasoning: With references to established sources.

Understanding the Context: To grasp the circumstances surrounding the issue.

Facilitating Matters: To ease difficulties for individuals.

Additionally, attention is given to the Objectives of Sharia and the avoidance of prohibited legal tricks that contradict these objectives.
